Terms of Use

These Terms of Use ("Terms") govern your use of the Zivanerive mobile application and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and account

You must be at least 13 years old, or the minimum age required in your country, to use the Service. If you are under the age of legal majority, a parent or guardian must review and agree to these Terms. You are responsible for activity under your account and for keeping your access credentials secure. Information you provide must be accurate and lawful.

2. The Service

Zivanerive provides hairstyle inspiration, AI-assisted hairstyle previews, image collections, community posting and interaction, messaging, and related creative tools. Features may change, be suspended, or be discontinued. Internet access and a compatible device may be required.

3. AI-generated results

AI previews are generated from the images and choices you submit. Results may be inaccurate, incomplete, unrealistic, or unsuitable. They are for entertainment and style exploration only and are not professional, medical, cosmetic, or safety advice. Do not rely on a generated result as a guarantee of an actual haircut, color treatment, or appearance. You are responsible for reviewing results before saving, sharing, or acting on them.

You confirm that you have the rights and permissions needed to upload each image, including consent from any identifiable person shown. Do not upload sensitive, unlawful, sexually explicit, exploitative, or infringing material.

4. User content and license

"User Content" includes photos, posts, comments, messages, profile information, and other material you submit. You retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and transmit User Content only as reasonably necessary to operate, secure, improve, and provide the Service.

You are solely responsible for your User Content. You must not post content that violates law, privacy, publicity, intellectual property, or other rights; impersonates another person; contains threats, harassment, hate, spam, malware, or sexual exploitation; or promotes dangerous or fraudulent conduct.

5. Community safety and moderation

Users may report content or accounts and may block other users. We may review, restrict, remove, or preserve content; limit interactions; suspend or terminate access; or cooperate with lawful requests when reasonably necessary to enforce these Terms, protect users, or comply with law. We do not guarantee that all objectionable content will be identified or removed.

6. Virtual coins and in-app purchases

The Service may offer consumable virtual coins through Apple In-App Purchase. Coins have no cash value, are not legal tender, cannot be transferred, and may be used only for eligible features in Zivanerive. Except where required by law or Apple's policies, completed purchases are final and non-refundable. Apple processes payments and controls billing, refunds, and purchase records. Refund requests should be submitted through Apple's Report a Problem service.

We may adjust coin pricing or availability prospectively. We will not remove purchased, unused coins without a legitimate reason such as a refund, chargeback, fraud, legal requirement, or account termination for a serious violation.

7. Permissions and device features

Camera and photo-library access are optional and used when you choose images for previews, profiles, or posts. Microphone access is used only when you choose to record a voice message. Saving and sharing use device features you initiate. You can manage permissions in iOS Settings, although disabling one may make the related feature unavailable.

8. Intellectual property

The Service, excluding User Content, is owned by or licensed to Zivanerive and is protected by intellectual property laws. You may use it only for personal, non-commercial purposes under these Terms. You may not copy, reverse engineer, scrape, resell, disrupt, or bypass security or access controls except where applicable law expressly permits.

9. Account deletion and termination

You may delete your account from My Chair > Delete Account. Deletion removes associated user-generated data as described in our Privacy Policy, subject to limited legal, security, fraud-prevention, and transaction-record retention. Deleting the app does not by itself request account deletion.

We may suspend or terminate access for a material breach, risk to users or the Service, fraud, or legal necessity. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations, and dispute provisions.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We do not warrant uninterrupted operation, permanent storage, accuracy of AI output, or that the Service will meet every requirement. Nothing in these Terms excludes consumer rights that cannot lawfully be excluded.

11. Limitation of liability

To the maximum extent permitted by law, Zivanerive and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, goodwill, or opportunities arising from the Service. Our aggregate liability will not exceed the greater of the amount you paid for the Service during the 12 months before the claim or USD $50. These limits do not apply where prohibited by law.

12. Apple-required terms

These Terms are between you and Zivanerive, not Apple Inc. Apple is not responsible for the Service, its content, maintenance, support, warranties, or claims relating to it. If the Service fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by Apple policy. Apple has no other warranty obligation to the maximum extent permitted by law.

Zivanerive, not Apple, is responsible for addressing claims relating to the Service, including product liability, legal or regulatory compliance, and intellectual property claims. You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on a U.S. Government prohibited or restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes and governing law

We may update these Terms. We will post the revised version and update the effective date, and will provide additional notice when required. Continued use after an update becomes effective constitutes acceptance where permitted by law. These Terms are governed by applicable law without depriving you of mandatory protections in your place of residence.
